Amendments to Annex I of the EC Dual-Use Regulation due to the Delegated Regulation (EU) No. 1382/2014, which entered into force on December 31, 2014

What is the EC Dual-Use Regulation?

The EC Dual-Use Regulation (Regulation (EC) No. 428/2009) governs the control of exports of goods, including software and technology, that have a dual-use purpose within the European Community.

The term “dual-use” refers to goods that can be used for both civilian and military purposes.

Annex I of the EC Dual-Use Regulation contains a list of goods that are specifically affected and may not be exported to another country without prior authorization.

What changes have been made, and what do they mean for the export of frequency converters?

The relevant technical specifications for the export of frequency converters are found under item 3A225 of Annex I of the aforementioned regulation. Due to the amendment of the specified technical characteristics, export controls for frequency converters have been expanded.

Frequency converters (listed under item 3A225) with an “operating frequency equal to or greater than 600 Hz” are now subject to export control.

This means that our ARS 2000, ARS 2000 FS, and ARS 2000 SE families, as well as the DIS-2 48/10 and DIS-2 310/2 product families, are now subject to export authorization requirements, whereas they were previously exportable without such approval.

How can I determine whether the export of a frequency converter requires authorization?

If the export of a Metronix servo drive requires authorization, Metronix will indicate this on all relevant business documents (quotes, orders, delivery notes, etc.) with the following notice:
“Export-controlled product – AL No.: 3A225”

Will the availability of Metronix servo drives be affected by this amended regulation?

No. In cases where Metronix exports products subject to authorization to countries outside the EU, Metronix ensures that the necessary export licenses are obtained, thereby guaranteeing product availability.
As a result, there will be no significant change to the current availability of frequency converters.

What are the customs tariff numbers for Metronix servo drives?

The customs tariff numbers for Metronix servo drives are:

• 85044084 for power ≤ 7.5 kVA
• 85044088 for power > 7.5 kVA

What should I do if I want to export a Metronix servo drive to another country?

Shipments within the European Community:
No export authorization is required for deliveries within the EU.
However, all relevant business documents must include a note on export authorization requirements in case of export outside the EU.

Exports of servo drives from Germany to non-EU countries requiring authorization:
To streamline export control procedures, the German Federal Office for Economic Affairs and Export Control (BAFA) has introduced a simplified procedure in the form of the General Export Authorization (AGG17) for the export of frequency converters.

This allows companies to avoid applying for individual licenses in most cases.
A General Export Authorization (AGG) is a special type of export license that has the same legal effect as individual authorizations but does not require a separate application. Instead, it is officially issued by BAFA and automatically applies to all exports that meet its conditions.
Thus, AGGs provide exporters with the advantage of immediate delivery capability and planning reliability for the duration of the authorization’s validity.

The AGG No. 17 can be used for the export of goods listed under 3A225 of Annex I of the EC Dual-Use Regulation, provided the final destination is not in Iran, North Korea, Pakistan, or Syria.

Can a Metronix customer use Metronix’s export authorization for exports to third countries?

No.
The export authorization is non-transferable.
In the case of resale to third countries, the Metronix customer must apply for their own export authorization from BAFA.
